Terms of Service

These Terms of Service govern your use of the Marmo Privacy software, website (usemarmo.xyz), co-signer service (api.usemarmo.xyz), and any associated applications (collectively, the "Service"), provided by Marmo Privacy ("we", "us", or "our"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

1. Self-Custody and Non-Custodial Nature

Marmo is a non-custodial tool. We do not hold, control, or have access to your funds. The Service splits a cryptographic key across three shards. We store only one encrypted shard (Shard B) on our co-signer server, encrypted such that we cannot decrypt it without your API key. You bear sole responsibility for the security of your other shards and your funds.

2. No Recovery of Lost Keys

If you lose access to two or more shards simultaneously and cannot reconstruct them, your funds are permanently inaccessible. We cannot recover your wallet. The 2-of-3 threshold scheme is designed for your protection; it equally protects against recovery by anyone, including us.

3. Beta Software

The Service is currently in beta. It is provided for testing and early access purposes. Features may change without notice. Do not store funds you cannot afford to lose on beta software. We strongly recommend limiting balances until the Service exits beta.

4. No Financial Advice

Nothing in the Service constitutes financial, investment, legal, or tax advice. All decisions regarding digital assets are solely your own. We are not a financial institution, broker, or money services business.

6. Co-Signer Service

The co-signer server holds your encrypted Shard B and co-signs transactions upon your request. We apply a daily spending limit (default: $1,000 USD equivalent) as a guard against unauthorized use. We reserve the right to suspend co-signing for accounts that appear to violate these terms.

7. Intellectual Property

The Service source code is released under the MIT License. The Marmo Privacy name, logo, and brand identity are owned by us and may not be used without permission.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, DATA, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
